Our general terms and conditions (as of Jan. 01, 2020)

1. REGISTRATION AND DEPOSIT

1.1 Registration takes place in writing (via email or registration form on the La Luz surf homepage). The registration becomes binding for the participant upon receipt at La Luz Surf, for La Luz Surf the bindingness is confirmed with the written registration confirmation and invoice (via email).

1.2 After receiving the confirmation of registration, a deposit of 50% of the course or invoice amount is due. The remaining amount is paid on arrival in cash or by bank transfer shortly before arrival.

1.3 Please transfer the deposit after receipt of the confirmation of registration by La Luz Surf to the following account (for all transfers please state name and course or travel date):

1.4 If no transfer is made to the account of La Luz Surf within the period stated in the confirmation of registration, La Luz Surf has the right to exclude the participant from the participation by giving notice of cancellation and to request a lump sum payment of 10% of the invoice amount from the participant.

2. PARTICIPATION CONDITIONS

2.1 The participant expressly declares that, from a medical point of view, there are no concerns about the practice of surfing and all other (sporting) activities in which he participates.

2.2 All sporting activities are always at your own risk.

2.3 Only adults (at least 18 years old) are allowed to stay at La Luz Surf. In exceptional cases, a special agreement can be made between La Luz Surf and the underage participant and their legal guardian.

3. SERVICES

The participation price includes the services specified in the booking confirmation. La Luz Surf reserves the right to deviate from the individual travel services, provided these were necessary for objectively justified, substantial and unforeseeable reasons after the conclusion of the contract and these do not significantly affect the overall average stay. Arrivals and departures are to be organized by the participants on their own responsibility and are not part of the performance of La Luz Surf.

4. WITHDRAWAL BY THE PARTICIPANT

4.1 Cancellation by the participant is possible at any time and must be in writing. If the participant withdraws from the contract or does not start the trip, he must pay La Luz Surf a cancellation fee.

4.2 The cancellation fees depend on the total price. The following cancellation fees apply:
up to 60 days before the start of the trip € 50.00
from 59 to 30 days before the start of the trip 25% of the total amount
from 29 to 15 days before the start of the trip 50% of the total amount
from 14 to 7 days before the start of the trip 75% of the total amount
from the 6th day before the start of the trip 100% of the total amount

4.3 The decisive factor for calculating the deadlines is the time of receipt of the letter of cancellation at La Luz Surf.

4.4. Before the start of the trip, the participant can provide a replacement person who meets the requirements for the stay set by La Luz Surf (e.g. minimum age 18 years). There is a fee of € 25.00 for this.

4.5 La Luz Surf retains the right to the travel price even if the participant is responsible for bodily harm.

4.6 We recommend taking out travel cancellation insurance.

5. CANCELLATION AND CANCELLATION BY LA LUZ SURF

In the following cases, La Luz Surf can withdraw from the travel contract or cancel the travel contract after the start of the trip:

a) Cancellation of the contract due to exceptional circumstances
If the stay is not reasonable for the participant due to force majeure (e.g. epidemics, storms, catastrophes, war) or unreasonable danger, La Luz Surf has the right to terminate the travel contract with immediate effect. The payments made will be reimbursed taking into account the costs of La Luz Surf.

b) Exclusion from travel
If, despite a warning from La Luz Surf, the participant permanently disturbs (e.g. does not follow the instructions of the course instructor) or if he behaves contrary to the contract to such an extent that the immediate cancellation of the contract is justified, La Luz Surf cancels the travel contract without notice. If La Luz Surf cancels, La Luz Surf retains the right to the travel price.

6. LIABILITY

6.1 La Luz Surf is not liable for accidents, possible traffic disruptions, delays and the associated postponements, as well as for any follow-up costs that might arise for the participant.

6.2 Participation in the surf course, the (sporty) activities offered, arrival, use of the services mentioned and the stay are at your own risk.

6.3. La Luz Surf’s liability does not extend to dangers that are inevitably associated with wave riding or the (sporting) activities offered and which the participant consciously accepts. It also does not extend to any damage that the participant incurs while surfing or participating in the (sporting) activities offered through the fault of other participants or third parties.

6.4 La Luz Surf is not liable for service disruptions in connection with services that are only brokered as external services (e.g. flights, sporting events, excursions, exhibitions, apartment brokerage).

6.4 Liability for loss and damage to participants’ property on the part of La Luz Surf is excluded.

6.6 The surfing equipment, all sports equipment and other objects that are the property of La Luz Surf are to be treated properly by the participants. In the case of grossly negligent damage and loss, the participant is liable for the damage incurred.

7. LIMITATION OF LIABILITY

The contractual liability of La Luz Surf due to the participant’s contractual claims for damages is limited to three times the travel price, insofar as the participant is neither deliberately nor grossly negligent.

8. INSURANCE

Travel cancellation insurance is not included in the price. We recommend that you take out one, as well as taking out travel accident, luggage, foreign health insurance and private liability insurance is advisable.

9. CHANGE OF EVENT HISTORY

Changes in the course of the event cannot be ruled out. The program (surf course, individual activities, etc.) can be changed and an alternative program can be offered, particularly in the case of weather-related dangers. In such cases, the participant is not entitled to a refund of the travel price or a partial amount.

10. WARRANTY

10.1 The participant agrees that instead of his right to change or price reduction, La Luz Surf will provide him with a defect-free service within a reasonable period of time or improve the defective service.

10.2 Remedial action can be taken in such a way that the defect is remedied or an equivalent or higher equivalent replacement service is provided, which also receives the express consent of the participant. The notification of defects must be made on site. La Luz Surf can refuse the remedy if it requires a disproportionate effort.

10.3 The participant is obliged to cooperate in the event of performance disruptions within the framework of the statutory provisions, to avoid any damage or to keep it less.

10.4 The participant is particularly obliged to inform La Luz Surf of his complaint immediately on site. This is instructed to remedy the situation, if possible.

11. EXCLUSION OF CLAIMS / LIMITATION

11.1 The participant must assert claims against La Luz Surf within one month of the contractually agreed end of the trip due to inadequate travel services, subsequent impossibilities and breach of secondary obligations.

11.2 After the deadline has expired, claims can only be asserted if the participant was unable to meet the stated deadline through no fault of his own. The participant’s claims expire 6 months after the contractual end of the trip.

12. Passport, visa and health regulations, insurance

12.1 The traveler is responsible for complying with all regulations that are important for the implementation of the trip. For travelers without German citizenship, there is an obligation to obtain information about passport, visa and health regulations from the responsible consulate.

12.2 Should the traveler fail to comply with the entry requirements of individual countries, or should a visa not be issued in good time through the fault of the traveler, so that the traveler is prevented from traveling, La Luz Surf can charge the traveler with appropriate cancellation fees.

13. SPECIAL NOTES

Since the arrival and departure of the various guest groups falls on one day when the guests change, the necessary cleaning and preparation of the rooms for the new guests can mean that they are not immediately available. The rooms are always cleaned when guests change and at least once a week. The bathrooms are cleaned daily.

14. IMAGE USE / DATA USE / DATA PROTECTION

14.1 The participant agrees that he can take photos of events and sporting activities during the trip and that these photos may be used in the context of advertising for La Luz Surf. This consent can be withdrawn at any time in writing.

14.2 The participant agrees that the data collected about his / her person (inventory data) will be used for market research and marketing purposes. With regard to the registered data of the participants, La Luz Surf undertakes to comply with the data protection and media law provisions. In particular, the data will be treated confidentially. The participant can revoke their consent at any time in writing. If he has withdrawn his consent, data will not be used in accordance with this paragraph.

15. SEVERABILITY CLAUSE

The ineffectiveness of individual provisions does not justify the ineffectiveness of the travel contract or the other provisions of the small print.
